Another part of Tonya's claim is that this wasn't an isolated incident and that it's common practice for the producers to encourage male castmates to act inappropriately towards female castmates. But I feel like if this were the case, it would be spoken about a lot more. Most of the people on these challenges are extremely accessible, what with Twitter and Facebook and even Formspring. They're also a very vocal bunch. Someone, probably a lot of someones, would have spoken out about being violated, or even simply uncomfortable, with the way producers handled things in the past. But instead, the only negative things ever said about the producers is that they edit things poorly. I mean think about it. Girls flip out in that house constantly over the smallest things, ie Wes pouring soda on Cara Maria's head. And you think they'd all just sit quietly while producers encouraged them to be sexually harassed?
Yeah those loudmouths couldn't keep a secret like this. Also Tonya's erratic behavior makes her a uncredible person. It's easy to believe (just pull up images of people you've seen behave as jerks ten thousand times actually doing this...), but hard to believe if you look at the facts (mainly BMP filming the ordeal and doing nothing) - it just doesn't add up.
People see Tonya as an unstable person, so they are quick to dismiss this. Other people see Kenny and Evan as jerks, so they are quick to condemn them.
Very true. We're are guilty of passing judgement based on an edited version of all the parties involved.
And Kenny and Evan, surprisingly. No matter what the outcome, they've nationally been branded as rapists, which is kind of nuts.
I think they're immature jerks but I do feel sorry for them. Even if Tonya's accusations turn out to be false, they will be forever branded as the toothbrush rapists.
I dont expect this case to go to trial I think MTV and BMP will settle this out of court to save face.
Sadly, I think that there's no saving face. The fact that this is made public is a huge loss for MTV/BMP. Like Molds stated, insurance premiums have already increased. Even if they prove that Tonya is lying, the show will be under intense scrutiny.
I think people are more worried about this case effecting the future production of the challenges and the Real World more than what could happen to Kenny and Evan.
To your point, can they proceed with filming the next challenge even if they're under investigation?
C0py of the complaint and other info. Apparently they agreed to toll the statute of limitations on the case at one point so this has been in the pipeline awhile.

Fresh Meat starting killing the Challenges, and now they might kill them for good. Never been a big fan of "Kevin" but after reading this I dislike them even more. What they and maybe other male cast-members did to her was sick, but for production not to do anything was even more sicker.
What I'm finding really bizarre in this whole story is that everyone else who knew about it (witnessed it or heard about it) kept their mouths shut. I really can't believe that all these people (other cast and MTV staff alike) would all keep something like this quite.
However, if this turns out to be true this is a horribly frightening thing, not just for those directly involved, but for everyone who kept their mouths shut.

Quite a while, so all of the "Why is she just filing this now?" questions can stop.
Paragraph 2:
On May 7, 2010, Plaintiff filed timely charges against Defendants with the State of California Department of Fair Employment and Housing. ... Plaintiff received her right to sue notices on May 7, 2010 and November 19, 2010 and entered into agreements to toll the applicable statute of limitations with Defendants, which argument tolled the statute of limitations but required filing of this complaint on or before October 28, 2011.
Oh hey, look what today is.

Thanks for bringing over.

Paragraph 44 of the link above: "Even after Plaintiff and other cast members formally reported Defendants' Santucci and Starkman sexual assault of Plaintiff...."
So there were witnesses and they did say something.
Do you think that they will still film the next challenge whenever it was scheduled to be filmed?
I do so they can say this isn't a pattern of conduct and I also think they will do the couples format to make sure that nothing like that is likely to happen with significant others in the house while this suit is pending.
I find it hard to believe if someone like Katie or Susie saw this taking place, they'd keep quiet. Neither of them have ever shown a willingness to go along with Evan or Kenny.
Also, I know that we are all talking about the situation as if we know these people personally, but the fact is, we don't. I just feel it's disgusting that people like Emilee, Melinda, and Emily are finding this laughable. Melinda is the only one of them has met Tonya. I doubt either Em's have since Tonya parted ways with BMP after the Ruins and Emilee would have not even began filming Cancun. Those girls are going off of the fact that they have heard/seen how "crazy" Tonya can be and the fact that they're friends with Kenny and Evan obviously showed with side they took. The fact that Syrus has her back, WHO WAS THERE, and that Tina sounds like she's taking more of Tonya's side, and Johanna who wants nothing to do with the situation, leads me to believe the cast members who have known those guys longer know what they are capable of.

If this does indeed end up going to trial, you can bet that these people won't be able to keep their mouths shut for long - they'll be subpoenaed .

I do think they would keep quiet if they didn't want to get sued for breaking their contract.
Pleading the fifth's a good sign of guilt, don't you think?
Not really sure that would work anyway if the criminal jurisdiction is in Thailand. What will happen is anyone who expresses an opinion will likely be deposed to find out the basis of their opinion even if they weren't there so they could figure out who in the bunch has been saying things differently publicly than privately so her lawyers can grind them in the dust if they take the BMP side. That she has 3 law firms representing her is a pretty good signal to me that there is a case to be heard.
I honestly don't believe there's any merit to Tonya's claims. Not just because I'm a fan of Evan and Kenny. But because in every other case of assault, the violence was put to an end as soon as possible and the people involved were dealt with. People are always thrown out of the house for throwing punches and castmates are given the opportunity to boot another cast member if they feel "unsafe". Its extremely hard for me to believe this would be standard for fights but not rape.
Another part of Tonya's claim is that this wasn't an isolated incident and that it's common practice for the producers to encourage male castmates to act inappropriately towards female castmates. Jen Physically attacked Cara Maria on Rivals, and was not kicked off the show. Have you watched The Island? Johnny harassed multiple female cast members. I could go on forever. Watch the ruins! Watch how the female members of the champions team are treated by the male cast members. There's too many instances to mention. Bad behavior is clearly being encouraged by those who produce the show. The same offenders are invited back season after season. Finally someone has the courage to stand up and speak out, and fans on these boards are demonizing her. At this point Kenny, Evan, Johnny et al could do about anything, and their fans would make excuses and defend them. Watch the old episodes. There are dozens of incidents that BPM and MTV unapologetically aired on the show. Other incidents that were shown in the episodes didn't rise to this level of criminality or seriousness, but there is a clear history of the show encouraging this type of behavior, and of the fans even celebrating it.
BMP clearly has their favorites. I like Susie but she kicked and slapped Ace when he climbed into her bunk and nothing happened to her. I also think that Ty should have been kicked off for jumping on the bunk that he knocked over with Emily underneath it! Hahaha.
I may come off as an ******* by saying this but in all honesty Tonya became well known from being on the Real World and the challenges as being a attention ***** she clearly loved the attention she got on the Challenges and it got her famous enough to do playboy and some soft-core cinemax **** movies. Now 2 years since The Ruins she hasn't done anything and up until recently she was forgotten and now all of the sudden she saying she was raped with a toothbrush on The Ruins and that production encouraged it. To me any it sounds like she's making these claims to get the attention. Until more people from The Ruins step up and back up her claims I personally won't take her claims seriously.

The charges were filed over a year ago. I'd like to believe it isn't true too but the "this is out of nowhere" thing doesn't hold much weight at this point.

The lawsuit was filed in May of 2010. I haven't been able to find the filming date for the Ruins but I estimate it ended in April-May of 2009 (based on The Duel 2 reunion show and Brad's messed up eye being filmed in June). This was in the works well before the lawsuit was actually filed also.
I believe her. It's all caught on tape and the camera doesn't lie.
At first I wondered why she's not pressing criminal charges against Kenny and Evan, but then I remembered the incident took place in THAILAND, not the USA, and since incidents that occur outside of US jurisdiction cannot be tried in the USA, she can't press charges.

I agree with Cara Maria, it's disgusting. I'm glad that female cast members appear to have Tonya's back.
Things make so much sense now. I'm sure during the argument with Veronica she probably made a comment alluding to the incident. It makes since how Kenny and Evan quickly jumped to Tonya's defense once it happened, they were clearly doing damage control.

Good call, you're probably right.
I dont expect this case to go to trial I think MTV and BMP will settle this out of court to save face. But if this does go to trial I dont really see Tonya winning becuase she doesnt have any real concrete evidence to support her case other than word of mouth. Also, she has a well documented past of being well a lack of a better word "CRAZY". So I see that unless MTV and BMP wants to give her a settlement to keep her quiet is her only best option of "winning" because unless she gets more people to testify on her behalf and BMP actually has footage of this alleged rape, I dont really see Tonya winning this case
How many unwarranted claims and irrelevant ad hominem attacks can one person make on a single forum? I created an account solely for the purpose of replying to you. First of all, you have no clue what evidence she has. The information we have relating to this case is extremely limited. Second of all, had you actually read the articles before jumping to conclusions, you would've know that A. Tonya filed charges a year and half ago, and B. "Even after Plaintiff and other cast members formally reported Defendants' Santucci and Starkman sexual assault of Plaintiff..." Debunks your unfounded theory of not enough cast members backing her up.
Now, the character assassination that has been going on in this forum needs to be addressed. Calling her an "attention *****", and "crazy" (bonus points for ableism) makes it apparent that you're grasping at straws to make Tonya look bad, and any reason to not believe her. Why? I'm not sure. Rape is a serious topic, sweetie. The playboy stint has no relevance to this case. Just because she was in Playboy, that doesn't make her body public property. Do you have any clue how hard it must be for rape victims? People (like yourself) are dissecting every aspect of her life, any mistake she may have made, and throwing it in her face in a RAPE CASE. It's sounds like if anyone who isn't Mother Teresa-like claims that they were raped, they are already branded a man-hating liar, and the misogynists will come out and start blaming the victim. People like you, and the comments that you've been making are why so many rape victims don't step forward, and justice is hardly ever served in rape cases. You were correct when you suggested in your disclaimer that you may be coming off as an *******. Congratulations.
I believe her. On the *** they should have shown for the ruins. Cast members actually brag to the camera about how they would torment Tonya when she was too drunk to defend herself. We see people throwing baby powder in her face. And when she is passed out drunk, people move her and put her in other cast members beds as a "joke". I believe this was the same challenge where other cast members like susie invented a game they called "I hate Tonya because". They made it a contest to see who could say the most hurtful things about Tonya.
