Once in awhile, some people won't settle for any amount of money because they want the trial and the publicity and want the offending party to suffer. Some companies refuse also to settle any cases because to do so invites more claims so they make you fight for money to deter others. Not saying either is the case here, but it isn't always about quick bucks.

The two interesting things that I got out of that are that a) She was told by other cast members (she claims), and b) It seems like she's more after BMP than Kenny and Evan. The toothbrush incident seems to be more of an example of a pattern of behavior that she's suing for rather than her main concern. Of course, I may be wrong, but that's just how I read it.
I also want to say that, just because I'm defending Kenny and Evan right now doesn't mean I condone these actions. If this is true I think it's pretty disgusting and I will see them in a much different light than I do right now. HOWEVER I'm not willing to change my opinion of them based on an allegation.
Here are 3 possibilities
1) Tonya's basis for suing is so credible that she will not accept any settlement.
2) MTV/BMP have not offered enough for Tonya to settle.
3) Tonya is crazy and has no basis for suing and MTV doesn't want to settle because it will set a precedent that any crazy that comes on their shows can sue and get money.

I'm almost certain they would rather settle but now they have to go to court. It's not a matter of them wanting to go to trial because they don't think she has a case. They HAVE to go to trial because their settlement probably wasn't worth Tonya(and her lawyers) time.
This story is becoming HUGE! Eonline, USweekly, Perez, TMZ all are reporting it and are posting it as a top story. I feel like whether or not Tonya's allegations are true this is gonna be a PR nightmare for MTV and BMP. Not to mention a huge blow to Kenny and Evan's personal and professional life.
edit: I'd also like to add that because this story is getting so big, pretty soon Tonya is gonna get interviewed by a lot of these sites and/or magazines. I'm pretty sure a lot of our questions will be answered when that happens.

BTW, if there was video (say witnesses confirm it was shot and there is a gap in what is turned over) and it was destroyed, my guess would be that the court would nail Jon Murray to the courthouse door all [I]Beowulf[/I] style and absolutely everything negative presented about the defendants would be taken as true.

I'm pretty sure they have not gone to trial yet, but rather Tonya has just filed her complaint recently; and in California a civil complaint becomes a matter of public record as soon as it is filed. If they were going to trial or the trial was underway the media outlets would also have access to the answer sent in by the BMP and MTV.

With all of the mediation done before a civil suit actually goes to trial, I highly doubt that this has been filed recently. Remember how much of a time difference there was between Bananas saying he was going to sue, and then actually filing his complaint? She probably made her intentions known months ago and, facing no mediation, officially filed her suit yesterday.

First I have to say that this devastates me. I love the Challenge, I love Tonya, but most of all I love Kenny and Evan, my two favorites in the house. To Johnny joking around about it I have to say that Johnny would know more about what happened than Tonya because even if he wasn't there, Kenny and Evan would have come bursting in the room and being like "Dude, guess what we just did!"
That said, I don't think that they did. It doesn't seem like something that they would do. Yeah, you guys can say that they are slimy guys, but I don't think so. I think they are hilarious, and sure they can be mean sometimes, but I don't think that they would ever do that to a women. Kenny is an old fashioned Italian boy, who can be extremely sweet sometimes (like how he was with Cara Maria on the Rivals, and how he feels about Paula and betraying her on the Island). If anything Evan is even sweeter. He was the sweetest with Coral and he seems like the funniest person to be around. Out all of the boys, it seems like it would be Johnny that would do something like that because Johnny has little to no respect for people's space (not that I don't like Johnny).
Maybe it's because I am younger but, I am not finding this whole thing to be as devastating as everyone else does. Stuff like that goes on all the time and to honest, a lot of them time, the girls laugh about things like. I am extremely for innocent until proven guilty and a Challenge without Kenny or Evan is no Challenge at all.

Mediation can be done before the suit is filed but mostly mediation will be ordered by the judge after the lawsuit is filed or the parties will mutually agree to mediation after the lawsuit is filed. Just speculating I would think that mediation has not occurred but will happen once BMP and MTV file their response.

Probably because it's Tonya. I'm sure no one would be laughing if it had been Emily herself suing for something like this.
People see Tonya as an unstable person, so they are quick to dismiss this. Other people see Kenny and Evan as jerks, so they are quick to condemn them.
All I can say is...if this is true, I hope to never see any of the people involved on my TV again, and I hope MTV and BMP take a serious look at the environments they place their cast members in.
If this isn't true, Tonya needs more help than probably anyone could have guessed.
This whole thing is seriously crazy. I go to check my email this morning and Tonya Cooley is saying she was raped by a toothbrush. Thoughts? Lots of them. Mostly that I don't want the show to die. I've watched every episode of this show ever, including the prequels Real World All-Stars.
I really don't want to pass judgment because I don't know what really happened (as I'm sure most if not everyone on this thread falls) but just feel sorry for everyone involved. Tonya, if it proves true. And Kenny and Evan, surprisingly. No matter what the outcome, they've nationally been branded as rapists, which is kind of nuts. Even if what she said happened, I don't know if that's the term I'd use. It might be the legal term but it lumps them with some far more violent criminals. Can I see them taking a joke too far? Umm, yeah. But even if it's 100% true, I would not lump them with *** offenders that commit terrible offenses. Tonya's claiming that these shows ruined her life but they might have a better case at this precise moment.
Like I've said, I've watched these shows for tooo long and I can't help but have a few thoughts on Tonya and her character. No one's mentioned this yet (that I've seen) but she was filmed for a True Life at one point. Something about washed-up reality stars. It was when she was engaged to the guy she was divorced from on the Ruins and I don't think it was too many years before it. She was complaining about doing club appearances and these shows but needed the money. Can I see her wanting a financial escape? Yup. And she was a mess on the Ruins, undeniably. But do I think Kenny and Evan gave her a drinking problem and forced her to eat bugs? Ummm, no. All on her own. She's also been in this business for awhile. To keep creditors off her doorstep, she knows she has to book gigs which means staying in the press. She has indulged in more than a few incidents in the past for attention and/or publicity. Does anyone else remember her refusing to participate in the stripping challenge on Battle of the ***es? Some of the castmembers even commented that it seemed strange that she wasn't willing to participate. Contrast that with taking her top off for no reason on other challenges, sleeping with more than a couple of castmembers, and posing in Playboy. Real World: Chicago was a decade ago and I know her career needs the publicity. I just hope she's not blowing something out of proportion or using something really disturbing for personal gain. Again, I don't know her personally and have no idea what happened but I'm ruminating.
On another note, does anyone think Derrick's going to touch this with a 10 foot pole on his podcast? He was on the Ruins, is besties with the guys, and shacked with Tonya back in the day so I'd be interested if he was willing to discuss it.
I dont expect this case to go to trial I think MTV and BMP will settle this out of court to save face. But if this does go to trial I dont really see Tonya winning becuase she doesnt have any real concrete evidence to support her case other than word of mouth. Also, she has a well documented past of being well a lack of a better word "CRAZY". So I see that unless MTV and BMP wants to give her a settlement to keep her quiet is her only best option of "winning" because unless she gets more people to testify on her behalf and BMP actually has footage of this alleged rape, I dont really see Tonya winning this case
Maybe Tonya is not interested in settling or money. Perhaps her intent of the lawsuit is to force MTV to change the culture of the show. As people have posted, ripping off peoples clothes even if they are laughing shouldn't be televised on tv without consequences. I mean, wasn't that what the big deal with Tammy and Beth was about back in the day? And now it's just ok and possibly encouraged? MTV is presenting this behavior as normal and acceptable and "just a joke." Obviously I like the show, but the treatment of women on the challenges has been pretty offensive at times. I sometimes watch in awe and think, "Do other people really see what I'm seeing?" "Are women just used to being treated like **** so they don't event know it's happening." I kinda hoped that if people saw it they would say we need to change the behaviour, but it really seems to glamorizing it instead. I'd forgotten about Johnny pulling off Janelle's shirt. MTV shouldn't be putting people like him on the show continously when he doesn't apologize or learn from the behaviour and is instead rewarded. I think Tonya has a point in her lawsuit. MTV is creating this dynamic by putting a whole pack these guys together who denigrate women over and over.

At this point we just have to wait and see what happens. I think people are more worried about this case effecting the future production of the challenges and the Real World more than what could happen to Kenny and Evan. If this case becomes a case I guess I'll watch it on TruTV.
Can't believe this ridiculous story. It it's true.... these guys have gone over the line. Many of us said that JEK would be the end of these challenges, depending on what happens, that might actually be a truer than any of us imagined.

Not calling you out, but that is the exact same logic that makes people think they can get away with victimizing women and keeping women victims from coming forward.
