I think I remembeer someone saying that legally they have classified themselves as "gameshow" over a "competition" so they can influence the game to a greater degree without getting in trouble. They are not legally compelled to do seasons that are 100% fair which is how we get dumpster fire formats like Final Reckoning...that season was fair for literally no one.
The only test of this that I know of was by CBS asking the FCC enforcement staff for an opinion regarding Big Brother. One can find a BMP Challenge contract online. That contract binds the cast to many of the actionable clauses from the "Game Show Act," so, if ever tested in court, it would difficult to suggest that those pertinent clauses did not bind both parties. Frankly, I can't see any cast member suing BMP & MTV over "rigging" since none that are know are sufficiently independently wealthy to hire a big ticket law firm with the cajones to take on VIACOM/CBS.
I pretend TJ doesn't exist, his boring monotone hosting skills are horrible and I've always hated him. I lowkey almost stopped watching the challenge when he first came on as a host because it grated the **** out of me
