To be accurate, the two were not criminally charged with rape. Such charges would have been made by police in Thailand. This was a civil case filed in the California court system. In fairness to your point, however, there would seem to be a certain lack of symmetry involved, given the base allegation. It's not like these things tend to become more clear over time, either. The last major litigation involving reality TV occurred after Season one of Survivor, and nothing from that sealed settlement has ever made it into public notice.

Given that there was an overseeing entity(production) to find negligent. If they do it outside of the context of an overseas reality competition program, and instead say at a house party in a random U.S. city, this is likely a criminal matter not a civil. After all, what are you going to sue Kenny for? His spare room at his mother's place?

I've not heard Kenny really mention it much. Whereas Evan seems more "injured" by the decision like he thought he was infallible and cannot believe he has to endure the outcome. I always felt like Evan wore the pants between those two in the relationship anyway.
ok well since Sarah posted pics saying shes at Mtv studios, I guess its for the after show, Wes/CT/Jasmin are there too so I guess the whole Sarah/Trishelle thing involved those guys too, I'm gona guess some one hit Jasmine lol dont know how CT/Wes were involved unless it was an argument over who gets sent in

I think a lot of the rw alum are team jordan definately over Nia. At least all the challenge people seemed to like Jordan that is and in a drunken challenge house if he can get along he must not be so bad. .Someone tweeted Wes when he asked who was in NY to party with him/CT that portland cast woudl be there, and he goes who, they replied nia. He replied with "who else?" hahah like he is saying no thank you to that idea. So i imagine they heard all about her or maybe met her themselves. Side note i like Jordan but people seem to dislike him is all i meant by the not so bad thing.

They were on Rivals which was after the lawsuit (if I remember correctly)..It also looks like Kenny has an injury of some sort and has been telling people who tweet him that he's training to get back in reference to the challenge..None of these things spell out to me that they're done with challenges, just that the formats haven't worked out or another group of circumstances has kept them out. For instance I think Evan hosts some shows, he probably would come on only if he felt it suited him and if Kenny is really dealing with an injury I doubt he go without him.
Granted maybe they're more of a "liability" as far as costs go so they'll only use them on powered shows (like a Duel 3 or Old School/New School) which makes sense. They also might be on the side because it could **** people off to have them on the show because of what they were accused of doing but I don't think a part of the lawsuit was they're barred from appearing anymore. Liability, fan opinion, injuries, prior obligations or a combo of these could be reasons they haven't been on. I highly doubt not being allowed to appear was a part of the settlement

I highly doubt as well them not being allowed on a Challenge was part of the settlement. However, because of the lawsuit settlement and allegations, it is probably a high insurance premium to have them on a show. I know Evan mentioned on one of the podcasts he does that he and Kenny received availability calls for the next Challenge but weren't picked. Hence, the bitterness he exhibited in the podcast with Paula.
However, if the ratings go up a bit more this season and a format appears that suits one or both of them. I can see a scenario where BMP swallows the cost and pays a higher premium to put them on the show.
Whether that is right or wrong is left up to your opinion.

Unless the party and them being here led to the decision to film an aftershow while they're here? There's a lot of options but the fact they're all in NY is easily explained and Sarah alone being at MTV could be anything

That Scooter dude's birthday was a week ago, will they really fly all the way over there for a bday party? The after shows have always been in LA, so Idk, what about those unofficial after shows with some of the cast just talking about the episodes, are those in LA too? Battle of the Exes and Rivals are incredibly relevant considering Rivals, Battle of the Exes, and Battle of the Seasons play a major role in this cast. Rivals could familiarize the audience with the concept, and given that it was one of the best seasons rating wise and entertainment wise - it could work very well. Battle of the Exes and Battle of the Seasons are really where the Rivals for this series lie, including the original Rivals.

Also NY isn't "that far" from any of the people who went, the person who had the longest flight was most likely Wes who probably had the most friends there so it isn't the most baffling thing in the world for all of them to be there. I'm not saying it's not the after show but it could just be because of the party. If someone else other than Sarah is at MTV then I'd say you're right

They could be filming a preview for the season. Prior to Rivals and Battle of the Exes, I seem to remember a preview show explaining the beef for Rivals pairs and explaining the romance for Battle of the Exes. They could be doing the same thing here.
Also, note that for Battle of the Seasons, Evan and Paula filmed their online After Show in New York because they are local.
Could be any number of reasons they are there for Challenge business.

everything is filmed before, the only thing filmed after is the reunion. Even the after shows, even though one might be for ep2 and the other is ep8 they film them at the same time. I'm guessing its mtv related but who knows, especially how Wes is saying he has to get back to work and is leaving after only 1 day makes me think its a mandatory attendance kind of thing

It doesn't mean that Wes and CT were involved. Watch previous aftershows, there are multiple topics being discussed. For instance, maybe the first topic of discussion is Wes and CT as a team, maybe they did horrible in the first challenge, or won the first challenge, or stirred up some controversy with the rest of the house. Then perhaps Jasmine/Theresa were the team Sarah/Trishelle were to face when Trishelle pussed out. Just pure speculation with no proof of any of this whatsoever.

You misunderstood what I was saying; All those team-previews etc...are filmed at the challenge location before the first daily challenge actually takes place...
The episode aftershows are filmed about 2 weeks before the actual episode airs...
The reunion is filmed about 6 weeks in....
"Sh** They Should Have Shown" commentary after that...
I'm kind of sad that Naomi left early. Like I know even if she hadn't left on her own terms, she probably still wouldn't have lasted long, but I like her. She brings some much-needed humor to the shows, IMO.
I'm guessing there was no promo/trailer at the end of RW tonight, I really dont get how mtv is advertising this challenge, I remember the trailer for the last rivals was aired over a month before the premiere
