I'm really interested to know. I've heard an interview with Jordan where he says that BMP figured this might be the last season of the Real World so to get ratings they told the castmates that if a fight happened in which the two combatants were willing participants, they'd let them go at it. But I've also heard an interview with Averey where she says that she and Johnny were NOT willing combatants and actually retreated to their room, only to be constantly verbally abused by Nia in addition to her throwing multiple drinks on them...and that during this time, Averey placed more than one phone call to production telling them that she and Johnny wanted to leave, and production apparently drug their feet in responding. It basically sounded like Averey was calling them for help, and they ignored her. Pretty terrible, IMO.
How can BMP get away with that? I'm usually not all about suing people, but I mean, why aren't Johnny and Averey suing them? Isn't it in their contracts that physical fighting will lead to getting kicked out of the house? Actually, the reason they are not calling the cops or filing legal briefs is they want nothing more to do with BMP or MTV. They were legally obliged to be at the Reunion but Averey and Johnny pretty much want nothing to do with the production company or the network again. They just want to put it behind them.

There seems to be a lot of violence on the challenge doubt all those people get kicked off, maybe bmp rewrote their contracts. Actually, I'm going by what the cast has said. Marlon, Jordan, Averey, and Johnny have all said production pretty much sat on their hands and, in the case of the Marlon and Jordan, they were told flat out that they would be allowing fighting if both participants seemed okay with it. Averey called production twice when Nia was throwing drinks at her and they still took their time arriving even though they were located on the first floor of the building. Even 5 yrs ago, things would have been different.
I think it is fair to say that all of us who have watched for years have become disappointed with the way things have deteriorated and what the need for ratings has caused BMP to do to the franchise.
I think it's stupid and immature that Johnny hates Jessica because she's spoiled. I mean she may not be the independent woman he may feel she should be at her age. Regardless, it' s a stupid reason to dislike someone. It seems like Johnny is jealous an d wishes he had what she had.
I thought what Johnny told Tyler was extremely mean and uncalled for. I mean to say that Tyler deserved better than Jessica. I really feel bad for the girl.

Does anyone in this cast have the @ $50K needed just to set a breach of contract suit in motion? This is a very complicated issue and not likely a competent law firm with a track record of winning such cases is going to take on under a contingency arrangement. While I think they were wronged, it very difficult to win.

I know of no reason to believe that the Portland contract is in any way substantively different than recent year contracts (available elsewhere at vevmo and through Google at The Village Voice). The RW contract is based on the VIACOM realty TV contract that has its heritage in the CBS contract from when the two companies were one. I'm confident that I know and understand the contract since it was also the model for contracts we used at KGS Productions, Inc., Planet Beth Productions, and Vision 1 Media Group. Further to your questions, there are also elsewhere in the forum links to interviews with some of the cast (including Afterbuzz) where production's intervention or lack thereof was discussed point-by-point by Jordan. Certainly MTV has had the opportunity to state on it's website or to Afterbuzz, which is owned by their former host, Maria Menouous, and they have not responded to the allegations. This hardly makes MTV or its production company appear innocent.

Yeah, they would most likely need a contingency arrangement to file a lawsuit. I don't know how much they would be able to win, but I think that competent law firms would take this under a contingency arrangement because it seems like an easy win (the finances might not make sense for a competent firm to take the case though). I am not an expert on law, so it could be more difficult than I realized.

But would a judge actually give any leeway to a company giving out perpetual contracts? I thought people aren't supposed to do that, and the fact that they've been doing it for 25 years probably wouldn't look good on BMP.

That is always possible but unlikely. While there is a statue of limitations that runs from the date of the illegal act, you are really asking if BMP can pay them off to avoid an appeal to the district attorney for the filing of criminal charges. In affect, that would be bribery if presented to BMP that way by Avery and Johnny. Not what you had in mind, I suspect.
BMP isn't going to do anything unless Avery and Johnny act to bring the company to court -- whether Calif. Superior Court or through the Arbitration process stipulated in the contract. I can't imagine, as I've written before, that they have the resources to do that. It's expensive, especially when the object of your ire has very, very deep pockets. I'm sure that it took a very long time for BMP and MTV to recognize that Tonya was both serious and well-resourced. I've been told by sources close to the Hollywood insurance community, that the expectation was "Tonya is a flake and will eventually just go away. We can wait her out."
BTW, do you really think BMP cares if they look bad? My experience is that as long as the checks keep rolling in from the networks, they will do what they think is in their own best interest, viewers and morality be ******.

IMHO sadly no, with regards to MTV but Portland shouldn't they care? KNEEA went on TMZ and called the entire city trash. If they don't care then ... I have to leave that with them. Averery should stick up for herself legally though, I would certainly help her in anyway I could. What happened to her and the planned ambush/beating of Jordan is wrong and I would love to help her get justice for that experience.
I doubt Averey and Johnny would press charges now... I mean the show had stopped filming since last November so that whole Nia and Averey was like 7 months ago.

When Nia held up Daisy in the confessional and said "I got your dog *****" after the fight with Johnny and Averery and that was extreme and I was afraid for Daisy. It was apparant that she was using Daisy as an inanimate object just so she could get a rise out of Averery and/or Johnny. If she had touched my dog after I told her not and I found out ...let's just say it would not have been worth it.

I have two dogs as well, and it's pretty obvious to see that Nia in no way would hurt that dog. She tried to get Daisy to actually like her and when Daisy finally did, Nia wouldn't leave her alone. Listen, I know you don't like Nia, I get it. I didn't like her on the show either, but she didn't seem like the devil reincarnated; she seemed like somebody trying to put on a good television show.
