Real World: Tonya Cooley - Sues MTV For Alleged Assault

What disgusts me is that it's obvious that Kenny and Evan are deluded to a point where they think they are untouchable. They had the audacity to rape Tonya with a toothbrush on CAMERA in front of other cast members, and apparently still think they could get away with it. Disgusting and creepy.
Tanya clearly had a drinking problem, and the ******** they invite on these shows thought it was funny to pick on someone who was clearly troubled and in a very bad place emotionally.
I didn't think those guys would do something like that but if they did, I imagine the video would look something like this... Evan: Heeheehee should I do it? You guys dare me to do it? Kenny: Dude **** yeah, it's Tonya for ******'s sake, she doesn't even know what ******* planet she's on half the time. She'll forget it even happened within like 2 minutes. (Evan inserts toothbrush) Johnny: Oh my god dude... (JEK giggles collectively while each takes a turn with the utensil)
so if these charges were filed over a year and a half ago, i take it Kenny and Evan have known about this for some time now? That may explain why neither of them seemed like "themselves" last challenge.

Honestly, I think this thread should just be locked since it's nothing but people accusing one of the two sides of doing something wrong, when no one here was actually there and 99.99% of them have never even talked to any of the people involved. It's not going to go anywhere if it stays open.

Maybe I'm wrong but it seems to me that he's aware Kenny and Evan are not good guys, and doesn't seem to follow or worship them the way others do. But the dialogue seems realistic, nice job.
so if these charges were filed over a year and a half ago, i take it Kenny and Evan have known about this for some time now? That may explain why neither of them seemed like "themselves" last challenge.
If these charges were filed that long ago, then I would think BMP would know about it...then why were the two allowed to do Rivals with this cloud hanging over them? Seems like there's just a total abundance of incompetence within the production ranks and the whole outfit needs to be cleaned out if this series is to go forward.
Honestly, I think this thread should just be locked since it's nothing but people accusing one of the two sides of doing something wrong, when no one here was actually there and 99.99% of them have never even talked to any of the people involved. It's still an interesting topic that's open to the public - so why not discuss it?
Are any other competitors commenting? All I know so far is Cara Maria, Emily, Syrus, Tina, Emilee and Johnny. I wish Katie would speak up. I feel like she's one of the most honest cast members.

Assuming that the facts are true, it was a little more seedy. To summarize the scenario, production had been giving them booze all day with very little to eat so she was way drunk and trying to go to bed and they (Evan and Kenny) wouldn't let her, started throwing lotion and stuff all over her and harassed her until she completely passed out. It was then that the toothbrush stuff happened. I don't care if the victim is a drug-addicted prostitute, a sexual assault is a sexual assault and no person deserved to be treated the way she apparently was even before that happened. (not saying you were justifying--I'm just ranting)
Plus which castmembers were around to see this when it supposedly happened? I can't believe guys like Derrick, Brad, and Darrell would just sit back and get laughs out of witnessing such a thing.
Wait a minute, someone here said this lawsuit was filed a year and a half ago, but according to the article on CNN, it was filed yesterday: In a complaint filed in Los Angeles Superior Court on October 27, Cooley also cites her fellow "Real World/Road Rules Challenge: The Ruins" cast members Kenneth Santucci and Evan Starkman. MTV sued over 'Real World' *** assault claim - The Marquee Blog - CNN.com Blogs I'm confused
I wonder how the "Love me, I'm beautiful" and "SUCK YEAH" defense would fly in the court room.
I believe her. On the *** they should have shown for the ruins. Cast members actually brag to the camera about how they would torment Tonya when she was too drunk to defend herself. We see people throwing baby powder in her face. And when she is passed out drunk, people move her and put her in other cast members beds as a "joke". I believe this was the same challenge where other cast members like susie invented a game they called "I hate Tonya because". They made it a contest to see who could say the most hurtful things about Tonya.
The game was Inferno III - Susie, Cara, Colie, etc. No boys involved or at least not on anything that aired.
Plus which castmembers were around to see this when it supposedly happened? I can't believe guys like Derrick, Brad, and Darrell would just sit back and get laughs out of witnessing such a thing.
Yeah I thought that too, like would Couhatta, Brad and whoever just sit back and ignore something like that? But who knows maybe people werent around, could have been early in the morning and people were sleeping or passed out. And I wonder if they're going to have to get all the whole cast of the ruins to be questioned in court.

Even if this is true or not i feel like BMP won't ask Kenny and Evan back after this due to the stigma it has left. Makes me think that the lack of screentime they got on Rivals may have been a little deliberate...

Zoom in and read the 2nd paragraph.
Davis was involved in the whole "I hate Tonya because..." thing. But only a few times I think. And Kenny and Johnny were so different back then.
Plus which castmembers were around to see this when it supposedly happened? I can't believe guys like Derrick, Brad, and Darrell would just sit back and get laughs out of witnessing such a thing.
Looking at some of the clips from The Ruins, it doesn't look to me like these three hung out with JEK too often. It's possible that they were drunk don't remember it or weren't there. If you figure that Tonya was kicked off in episode 4, 7 people were gone at that point so there were at least 20 other people in the house at the time. There's no way in **** Evelyn would have kept her mouth shut about this so she was probably gone at that point. Either that or only a few people witnessed it and those are the ones who reported it. We don't know who they are either so it's possible that Derrick, Brad, and Darrell are in support of Tonya. Then again, the whole thing may have never happened so that's why they wouldn't have seen it. Derrick on the other hand is keeping his mouth shut since he's friends with Tonya as well as Evan and Kenny so he definitely doesn't want to get involved since no matter what the outcome is, he'd be going against one of his friends.

Guess we won't be hearing any podcasts from Derrick for a while, that could really help at a time like this...
yeah I know, so why are some people saying these charges were filed a year and a half ago?
"On May 7 ,2010 Plaintiff filed timely charges against Defendants with the State of California Department of Fair Employment and Housing" May 7th 2010 is almost exactly 1 and a half years ago. Just a smidge under.
yeah I know, so why are some people saying these charges were filed a year and a half ago?
She filed her claim with the state agency a year ago who cleared her to file suit but BMP/MTV requested the time in which to do that be extended to give them more time and today was the deadline for her to do it. So claim a year and a half ago, lawsuit this week.

Information travels quickly on these shows. If Brad knew, Tori probably knew and they had Evan at the wedding. They're both still friends with Sarah, Susie and Johanna. Darrell said he had Kenny's back going into FM2. I don't see how those things could still happen if they knew that this happened...and if one of them knew they ALL probably knew.
yeah I know, so why are some people saying these charges were filed a year and a half ago?
Did you look at the legal document at the bottom of the post? If not, check it out, and look at the 2nd paragraph at the bottom of page 2 of 36 and continued on the top of page 3 of 36. You'll see that it says that she filed charges on May 7th, 2010.

I don't really know but I don't think she loses credibility just because she didn't file right after it happened, a lot of rape victims don't speak up right away and maybe at the time she didn't know if she was done with MTV, and come on that's embarrassing. Who wants to reveal that they were raped with a toothbrush? Most women wouldn't go that far for attention for money maybe but it's not like it's guaranteed and if it's proven that she's making this up then she'll look like a complete moron. So I am hoping she considered that before going through with this and I don't think she would just make this up, something might have happened but maybe it's not exactly how she remembers it, but who knows, time will tell I guess. And I can't believe some of the cast is joking about it, even if you don't believe it, it's still a very serious offense and they should keep their mouths shut because they're involved with MTV/BMP and let the court deal with it, that's what the lawyers would tell you to do.

And, it says Tonya started to realize something was up, when people were treating her differently the next day. Presumably other cast members also knew about the dozens of other misogynistic remarks and actions Kenny, Evan, Johnny et al have displayed on camera over the years, in dozens of televised episodes. However other cast members, and many of the fans on these boards seem to find this misogynistic behavior: funny, acceptable and endearing.

It shouldn't matter when it was filed. With all of the victim-blaming that goes on in this world, I can see why it would take someone a long time to come forth. It's intimidating how people treat rape victims and scrutinize every thing they have ever done, despite events being irrelevant. I don't think I would've come forward if I were in her, and I were rape survivor. Nothing adds salt to flesh wound like people saying that you're a crazy, drunken, attention-seeking liar looking for a payday. The least people like Johnny, Melinda, Emily (DC), and Emilee (Cancun) could have done was not talk about it, and refrain from mocking rape. Rape jokes aren't funny, and who knows if they have followers that were victims of sexual assault and triggered by what they said? People are so inconsiderate these days.
