Honestly doubt it, i bet if Brad won he would probably buy a new motorcycle, a improved shack in the mountains or something like that, he didn't even try to spend christmas with his kids this year

Most custody agreements allow for flexibility. Most divorced families find a way for both parents to get time with the kids for the holiday especially if they live close. But maybe Brad moved? Brad and Tori clearly aren't friendly though so I could easily see it being a situation where they aren't flexible.
Tori lives in Nashville and Brad lives in Chicago still, I believe. So the common sense solution would be to alternate holidays, it has nothing to do with flexibility.
