Kenny and Evan got no money out of it, so I'm not sure what money has to do with it. I also think that Tonya was only seeking damages from Viacom, and Kenny and Evan were only named in the case. It's like when a cab driver hits someone...do you sue the cabbie who probably has nothing or the cab company with all of the money? It's likely that Viacom had more to say about the terms of the settlement and told Kenny and Evan that they had to stay off the show to avoid going to court where, guilty or innocent, their reputations would be even worse off. Even if they went to trial and it was found that the stuff didn't happen, it would probably a couple years worth of trial where they would be dragged through the mud and would be convicted in the court of the public opinion no matter what happened. And once they agreed to be bound by the terms of the settlement they signed and NDA and CAN'T talk about it even if they wanted to. It looks shady, and it's entirely possible that they did do it, but in my opinion they were in a lose/lose situation and they were probably better off with a settlement than a drawn out trial regardless of the outcome. And even if they did want to go to trial they were probably heavily pressured by BMP to sign on the line.
(And just so I'm clear, I said when this whole thing first came out that if it was found that they did this then they should be thanking their lucky stars it wasn't a criminal issue as they should be rotting in jail. However, I do believe in innocent until guilty).
